In Texas, those seeking divorce must meet certain requirements in order to be eligible for divorce. For instance, one spouse must have been a legal resident of the state for at least 6 months prior to filing. In addition, this person must have lived in their current county for at least 90 days.

Reason for Divorce

Texas is one of only a handful of states that recognizes both fault-based and no-fault divorce. This means a couple can site the reasoning for divorce in their official petition with the court.

Common grounds for divorce include:

  • adultery;
  • unreasonable cruelty;
  • a felony conviction;
  • living separately for at least 3 years;
  • spousal abandonment for at least 1 year; and/or
  • indefinite confinement in a mental health facility.

If either party chooses to cite fault in their divorce, they must be prepared to back up their claims with evidence to its legitimacy.

Common Divorce Issues

Before a divorce can be finalized, both parties must agree on how they would like to resolve key issues. Doing so is often much simpler in an uncontested divorce and, sometimes, the parties will not even need to set foot inside a courtroom. However, if the parties cannot agree on how they would like to resolve these key issues, they will need to take their case to a Texas courtroom.

Our Sugar Land attorney is knowledgeable in a variety of divorce-related issues and can help you argue your case in front of a judge.

The Vendt Law Firm, PLLC can help you resolve issues with:

  • Child custody: In Texas, child custody is known as “conservatorship.” Matters of conservatorship are often the most hotly contested among divorcing spouses. We can help you establish a workable agreement with your estranged spouse.
  • Spousal maintenance: Also called alimony, this is awarded in cases where one spouse makes significantly more income than the other. Generally, it is intended to assist the lesser-earning spouse in maintaining the standard of living they enjoyed during the marriage. Because Texas family court judges can determine spousal maintenance at their own discretion, it’s important to have an experienced divorce attorney by your side to help you with matters of spousal maintenance.
  • Division of property: Texas is a community property state, which means the property acquired during your marriage must be divided evenly between both spouses, whereas separate property will remain with the spouse who brought it into the marriage. It’s important to note that although the law states the division of property should be equitable, this does not mean division will be equal. Equitability relies on a few different factors concerning the divorce, such as income level and the standard of living each spouse is accustomed to.
